Although the original documents can be sent by any means (fax, e-mail), the sworn translation can only be supplied on paper as it has to include the signature and seal of a sworn translator recognized by the Jakarta Provincial Government.

Numerous official bodies in Indonesia and abroad require this type of translation (ministries, courts, academic institutions). Sesungguhnya Penerjemah Tersumpah atau Terjemahan Tersumpah disebutkan atau diadakan untuk mempertegas bahwa mereka harus melakukan pekerjaan penerjemahan secara ekstra hati-hati guna menghasilkan hasil terjemahan yang tidak menyimpang dari makna yang dimaksud dalam bahasa sumber (source language). Selain itu, mereka juga harus menjaga kerahasiaan dokumen yang diterjemahkan karena dokumen tersebut berisikan informasi-informasi penting yang bersifat sangat rahasia dan bermakna vital bagi pemilik dokumen tersebut.

Predikat Penerjemah Tersumpah diberikan apabila calon penerjemah atau seseorang telah mengikuti ujian kualifikasi penerjemahan yang saat ini hanya diselenggarakan oleh Fakultas Ilmu Budaya (dulu Fakultas Sastra, Universitas Indonesia dan lulus dengan nilai A (minimal angka 80). Selanjutnya, calon penerjemah tersumpah ini akan diambil sumpahnya atau dilantik oleh Gubernur DKI Jakarta atau pejabat yang ditunjuknya. Di Indonesia, penerjemah tersumpah dikukuhkan melalui Surat Keputusan Gubernur DKI Jakarta.

Sebagian penerjemah tersumpah juga mendaftarkan tanda-tangan atau cap mereka pada kedutaan-kedutaan besar di Jakarta guna mempermudah pihak kedutaan untuk memvalidasi hasil terjemahan tersebut melalui cap dan tanda-tangan yang telah didaftarkan tersebut, sehingga klien (pengguna jasa penerjemahan) dimudahkan.

Jasa penerjemah tersumpah biasanya dibutuhkan untuk menerjemahkan dokumen-dokumen pribadi seperti akte lahir, ijazah, rapor siswa, kartu keluarga, dan lain sebagainya. Jasa ini diperlukan terutama oleh mereka yang bermaksud untuk melanjutkan sekolah di luar negeri atau mengurus dokumen keimigrasian di luar negeri.

Sebagian sekolah, universitas dan/atau kedutaan mensyaratkan dokumen yang diperlukan, terutama yang ditulis dalam bahasa Indonesia, (dalam hal ini) untuk diterjemahkan ke dalam Bahasa Inggris (atau bahasa asing lainnya) oleh Penerjemah Tersumpah (Certified Translator).

It is preferable to print the translator’s certification on the same page as part of the translation, so as to reduce the possibility of mistake or substitution. It is not necessary to address the certification to anyone. (Ray Roman J.D., Honyaku, 5 September 1999)

Depending on the laws of the country in which the certification will be used, the statement of accuracy and completeness, if not in the form of a declaration, will probably have to be sworn to (oath/affidavit) before a notary public or other such officially recognized witness. U.S. law allows substitution of a statutory declaration in place of a sworn oath under most circumstances, and it is very easy to add the few lines necessary to transform the statement into a statutory declaration, in which case the statement need not be sworn to before a notary public. If you are not using the statutory declaration format, or the laws of the country in which the certification will be used do not permit substitution of a declaration for an oath, you will probably need to have your signature witnessed, or “notarized,” by – depending on the laws of the applicable country – a solicitor, notary public or justice of the peace (so don’t sign in advance). Have the authorized person witnessing your signature sign/stamp/seal your statement and preferably also emboss it with his or her official seal (this service is free or available at a nominal charge in most countries). This simply demonstrates that they have seen you sign the document – it is you who is attesting to the accuracy of the translation. Each certified document that you deliver to your client will generally have to be individually notarized in this way – photocopies are generally not acceptable.

Be sure to sign and date your statement of accuracy (but don’t sign or date in advance if you’ll be getting your statement notarized). Further identification (your company name, address, phone number, etc.) and the venue (place where executed = signed) are also nice touches. You can even get one of those embossing seals made to your order with words like “[Insert your name here], Professional Translator,” and use that to emboss one of those big old starburst-type seals which you can stick next to your signature for the full legal effect. If a legal firm sends you a prepared statutory declaration to sign and it contains an error, cross it out and initial the change. The person witnessing the declaration will also have to initial the change.

Do not confuse certification with accreditation. Certification refers to a statement as to the accuracy of one’s translation, while accreditation refers to recognition of one’s professional competence by an external accrediting body such as the American Translators Association, the Institute of Linguists, or the National Accrediting Authority for Translators & Interpreters (NAATI).

Below are some sample formats for certifying the accuracy of your translations.

For years, we have been conducting an annual qualification examination for translators in two categories of translation: translation of general texts and that of legal texts. UI certificates are awarded to those obtaining the minimum score of 65. Applicants of legal texts certification who reach the minimum score of 80 (grade A) are entitled to be nominated as sworn translators. Their oaths are taken by the Governor of Jakarta Province.

This year, we are going to adopt a new exam scheme, producing only two types of results: pass or fail. With the support of Association of Indonesian Translators, we will disseminate to our clients the need to refer to this certification to guarantee the quality of the translators they are hiring.

Also, starting this year, we are going to broaden the scope of our examination to cover other areas outside Jakarta. In three years, we aim to conduct this exam in several major cities throughout Indonesia, and should demand arise, we will also facilitate the local governments to take oaths of the translators dealing with translation of legal documents.
